By accessing or using the VIPKid website (the “Site”), services, software, applications, and/or content (collectively, the “Services”) made available by VIPTEACHER PTE. LTD. (together, with its subsidiaries, affiliates, parents, related companies, licensees, successors, partners, and/or assigns, “VIPKid” or the “Company”), you are consenting to VIPKid’s collection and use of your private information as outlined in this Privacy Policy. When you use the Services, you also agree to our Terms of Service. Please note that the VIPKid Privacy Policy applies to our collection and use of data collected from parents, teachers, and children. As described below, we use the information we collect from school administrators, teachers, parents, guardians, and students in connection with their use of our Services to provide the Services to your school, and to inform and improve the same.

3. A special note to international users

If you are a user accessing the Services from outside of the United States, such as the European Union (EU) or any other country or region, please note that you are transferring your Personal Information to the United States and China, which may not have the same data protection laws as the laws governing personal data collection, use, and disclosure in the EU and other countries or regions.By providing your Personal Information (defined below) to us through our Site or Services, you consent to the following:

Collection, use, and disclosure of your Personal Information in accordance with the Privacy Policy; and
The transfer and storage of your Personal Information in the United States and China, and the processing of the Personal Information globally.

4. Personal Information

“Personal Information”, means information that alone, or when in combination with other information, may be used to readily identify, contact, or locate you, or issue payment or tax information to you, such as, but not limited to, your name, address, email address, phone number, social security number, or bank account information.

We do not knowingly seek or collect Personal Information from users under the age of 13. If we determine we have inadvertently gathered personal information from a user under the age of 13, we will promptly delete any and all such personal information from our records. The Children's Online Privacy Protection Act of 1998 (COPPA) and other laws have been established to protect the privacy of minors and we abide by all federal and state laws and guidelines regarding youth privacy.

We do not consider Personal Information to include information that has been aggregated and/or de-identified so that it does not allow a third party to easily identify a specific individual.

We collect the following types of information (collectively, the “Authorized Information”):

Information about a student’s parent or guardian, such as, but not limited to, first names and email addresses. This information may be submitted by a teacher, parent, or guardian, and we may associate it with a student’s information.
Information submitted by a teacher, parent, or guardian about the students in a particular classroom, such as, but not limited to, first names, usernames and passwords, gender and other demographic information, grade level, learning level, or performance data.
Information submitted by a teacher about himself or herself, such as, but not limited to,first and last name, email address, profession, username and password, country of residence, school name, or school zip code.
Information and content submitted by a school, teacher, parent, or guardian, such as, but not limited to, lesson plans or notes.
Information and content submitted by a student, such as, but not limited to, responses to questions, activities, assignments, or postings to a forum viewable by others in the same class.
Information about the use of the Services, including a user’s general location (based on IP address or GPS), when, and for how long a user accesses our Services, what content a user views, or what actions he or she takes.
Information from or about a user’s device, such as mobile device type, browser type and version, operating system name and version, IP address, or referring URL. We collect this information automatically when you access our services, to help us understand usage, diagnose problems, administer our Services, and/or provide support.
Information collected through cookies, which are pieces of information stored directly on a user’s computer, or other persistent identifiers. We and our service providers use this information for security purposes, to facilitate navigation, to display information more effectively, to personalize your experience while using the Services, or to recognize your computer in order to assist your use of the Services. In general, the information we collect is used to:

To improve our services and enhance your experience with VIPKid.
To communicate with you on registration steps, class attendance, and class opportunities and offerings during and after your child’s tutoring sessions.
To schedule classes for students and coordinate class appointments with teachers.
To strategically place students into groups to optimize instruction based on learning needs.
To enable us to provide a safer community for all of our registered users.
To permit teachers to tailor and optimize our Services to the needs of a particular classroom or student.
To permit teachers to review students’ work, monitor students’ performance and progress, plan lessons, and otherwise support instruction.
To permit parents and guardians to review their childrens’ work and monitor their performance and progress.
To offer students feedback and support, permit them to access information shared by their teachers, suggest other content or activities for them, help them track their own progress and maintain a file of their work, and allow them to create a collection of books.
To personalize user experience, such as displaying a student’s name on his or her profile page or the teacher dashboard.
For analytics purposes, to understand how our Services are accessed and used, and how they perform, so that we may improve upon their design and functionality. We also perform analytics on aggregate information that does not permit the identification of any individual user.
To provide teachers with various types of reports, such as reports detailing the performance and progress of a particular classroom or student.
To communicate with teachers and parents or guardians, subject to any communications preferences they express.
To diagnose problems, troubleshoot issues, and provide maintenance and support.
To our third party service providers, who provide services such as website hosting and customer service, to permit them to provide those services to us.
To a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in bankruptcy or similar proceedings).

We may access, preserve, or disclose your Authorized Information or other account information if we believe doing so is required or appropriate to: (a) comply with law enforcement requests and legal process, such as a court order or subpoena; (b) respond to your requests; (c) protect yours, our or others’ rights, property, or safety; or (d) as otherwise required by law.

8. Updating or deleting your registration information

As part of the requirements for your use of our Site or Service, you are responsible for updating your submitted registration information so that it is current, complete and accurate. You can update this information by contacting us at info@vipteacher.com.

We strive to accommodate your request, though we cannot guarantee that the information can be successfully removed in all cases.

9. California Online Privacy Protection Act Compliance/Your California Privacy Rights

California residents who use this Site may request that we provide certain information regarding our disclosure of the user’s Personal Information. You can update this information by logging into your account and accessing information to third parties for their direct marketing purposes. 10. Do Not Track

We do not accept liability for unintentional access, use, or disclosure of your information or Personal Information.

As a user of our Site or Service, please remember to sign out of your VIPKid Account, and close your browser window whenever you leave your computer. This is to ensure that others cannot access your account or Personal Information. To help protect your VIPKid Account information, please keep your password secure and do not divulge your password to anyone. We suggest that you pick a non-obvious password that mixes numbers and letters. Ultimately, you are responsible for maintaining the secrecy of your passwords and any VIPKid Account information, and we are not responsible for the unauthorized use by third parties of information you post or otherwise make available publicly.
